Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the FluentOps websites, platform, CLI and related services (the “Service”). By creating an account or using the Service you agree to these Terms.

01Who we are

FluentOps (“FluentOps”, “we”, “us”) is a deployment platform operated as an independent business registered in Mexico. Paid subscriptions are sold and processed by our merchant of record, Paddle (see Section 6).

02Age and eligibility

You must be at least 16 years old to use the Service. You agree to provide accurate account information, keep your credentials confidential, and be responsible for all activity under your account.

03License to use the Service

We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service to build, deploy and operate your applications. You may not resell the Service, offer it as your own hosting product, reverse engineer it, or use it to build a competing service using our proprietary components.

04Your content

You keep full ownership of the code, data and content you deploy (“Your Content”). You grant us only the rights needed to operate the Service: to store, build, cache, serve, back up and display Your Content on your behalf. We claim no intellectual property rights over Your Content. You are responsible for having the rights to everything you deploy and for your application’s compliance with applicable laws.

05Free plan

The Free plan is offered for personal and evaluation use, subject to the limits published on our pricing page (projects, egress, build resources, sleep behavior, retention). We may adjust Free plan limits, or suspend Free deployments that degrade the platform, with reasonable notice where practical.

06Pro plan, payments and renewals

  • ·Pro is a monthly subscription of $7 USD (plus applicable taxes), charged automatically to your card at the start of each billing period.
  • ·Orders are processed by Paddle.com, our merchant of record. Paddle handles payment, applicable taxes, receipts and card storage; your purchase is also subject to Paddle’s buyer terms.
  • ·Your subscription renews automatically each month until you cancel. You can cancel at any time from your account; Pro remains active until the end of the paid period, then your account returns to the Free plan.
  • ·Usage above the included Pro allowances (e.g. egress) may incur overage charges at the rates published on the pricing page.
  • ·Refunds are handled per our Refund Policy.

07Acceptable use

You agree not to use the Service to:

  • ·host or distribute malware, phishing pages, or content that infringes third-party rights;
  • ·run illegal activities, or content that is fraudulent or deceptive;
  • ·mine cryptocurrency, run botnets, proxies/VPN exit nodes, or other abusive compute workloads;
  • ·attempt to breach, probe or overload the platform or other customers’ applications;
  • ·circumvent plan limits or metering.

We may suspend or remove deployments that violate this section, immediately where the violation is severe or affects other customers.

08Security

We apply industry-standard measures to protect the platform (see the Privacy Policy). You are responsible for the security and legal compliance of the applications you deploy, including any regulatory requirements that apply to your data (e.g. health or payment data). Please report suspected vulnerabilities to us promptly.

09Availability and changes to the Service

We work to keep the Service available and fast, but it is provided without a guaranteed service level. Features marked as beta or preview are provided as-is and may change or be removed. We may modify the Service; if a change materially reduces core functionality of a paid plan, we will give reasonable notice.

10Support

We provide reasonable-effort support by email. We do not guarantee response times on the Free plan.

11Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENTOPS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE OR DATA. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $50 USD IF YOU USE ONLY THE FREE PLAN.

13Indemnification

You will defend and hold us harmless from claims arising out of Your Content, your use of the Service in violation of these Terms, or your violation of applicable law.

14Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms (with notice where practical, immediately for severe abuse). After termination we may delete Your Content following a reasonable grace period.

15Changes to these Terms

We may update these Terms. If a change is material we will notify you (for example by email or an in-product notice) before it takes effect. Continued use of the Service after a change means you accept the updated Terms.

16Governing law

These Terms are governed by the laws of Mexico, and disputes will be resolved by the competent courts of Mexico City, without prejudice to mandatory consumer protections of your country of residence. Purchases processed by Paddle are additionally subject to Paddle’s buyer terms.
